Dynarii Credits Supplemental Terms
These supplemental terms (“Credit Terms”) govern the purchase, use, and management of Dynarii Credits and form part of the Terms of Service ( the “Terms”) governing your use of Dynarii's Services.
- Overview and Nature of Credits
Dynarii may permit you to purchase or earn usage credits, known as Dynarii Credits (“Credits”), for use with certain Services as further described in these Credit Terms, within the Services, or in your Account. Dynarii Credits represent a limited, revocable, prepaid right to access eligible Services, including premium stock sector match-up sets, contest entry fees, and digital items. These Credits are not money, currency, or a monetary equivalent. Dynarii Credits are not legal tender, are not redeemable, and are not refundable or exchangeable for cash or any sum of money except where required by applicable law. They have no equivalent value in fiat currency, do not act as a substitute for fiat currency, and do not constitute or confer any personal property right. Dynarii Credits do not represent a deposit, stored value, or balance held for your benefit and do not give rise to any fiduciary or custodial relationship.
- Promotional and Earned Credits
From time to time, Dynarii may issue Dynarii Credits without charge as part of a promotional, marketing, or trial program, referred to as Promotional Credits. You may also earn Dynarii Credits, known as Earned Credits, through in-game achievements such as active engagement, submitting correct stock picks, or winning contests.
Promotional and Earned Credits are subject to these Credit Terms unless otherwise expressly stated at the time of issuance and may be subject to additional restrictions, including limitations on use, expiration, or eligibility. These Credits will not be applied against any sales, use, gross receipts, or similar transaction-based taxes that may be applicable to you.
- Purchase of Credits
Credits may be purchased through your Account in accordance with the payment and billing provisions set forth in Section 7 (Billing, Payment, and Subscriptions) of the Terms. Credit purchases may be made as a one-time purchase.
The minimum Credit purchase amount is five U.S. dollars (USD $0.99), and the maximum Credit purchase amount is one hundred U.S. dollars (USD $100), in each case exclusive of applicable taxes. By purchasing Dynarii Credits, you authorize Dynarii (or its payment processor) to charge your selected Payment Method for the applicable amount, including any applicable taxes, and you acknowledge that Credits will be issued immediately upon successful payment. You acknowledge that the number of Dynarii Credits you receive is not fixed to the U.S. Dollar amount you pay, meaning Dynarii does not guarantee a set exchange rate or fixed value between U.S. Dollars and the number of Dynarii Credits issued.
- Use of Credits
Dynarii Credits may be used only to pay for eligible Services as expressly permitted by Dynarii and solely in connection with your Account. These uses include purchasing premium sets for stock sector match-ups, paying contest entry fees, and acquiring in-game items or tickets. At the discretion of Dynarii, Credits may also be redeemed for branded physical merchandise that is not otherwise available for direct purchase.
The rate at which Dynarii Credits are consumed may vary depending on the applicable Service, feature, or usage parameters and may change from time to time in accordance with these Credit Terms. You are responsible for reviewing applicable usage rates prior to using the Services. Dynarii Credits may not be transferred, sold, gifted, traded, sublicensed, or assigned, whether for value or otherwise, and any purported transfer is void.
- Account Balance and Responsibility
Your available Dynarii Credit balance may be reviewed through your Account. You are solely responsible for verifying that the correct number of credits has been added to or deducted from your balance based on your use of the Services.
Your credit balance is not a bank account, digital wallet, stored value account, or other payment device, and Dynarii is not a bank, money services business, or financial institution in connection with Dynarii Credits.
- Expiration of Credits
Unless otherwise specified at the time of purchase or issuance, all Dynarii Credits expire five (5) years after the date of purchase or issuance. Expired Credits are automatically removed from your Account and may not be reinstated. Dynarii has no obligation to provide notice prior to the expiration of Credits.
- No Refunds; Final Sale
All sales of Services, including sales of prepaid Services through the purchase of Dynarii Credits, are final. Except where required by applicable law, purchases of Dynarii Credits are non-refundable, and no refunds or additional Dynarii Credits will be provided for unused, partially used, expired, or forfeited Dynarii Credits.
Unused Dynarii Credits are not refundable upon Account suspension or termination under the Terms.
- Prohibited Transfers and Misuse
Dynarii prohibits and does not recognize any purported sale, transfer, gift, trade, or exchange of Dynarii Credits. Any attempt to use, sell, or transfer Credits in violation of these Credit Terms constitutes a material breach of the Terms and may result, at the discretion of Dynarii, in the revocation or cancellation of the affected Credits, forfeiture of any remaining Credits, and suspension or termination of your Account without refund.
- Changes to Credit Terms
Dynarii may modify credit pricing, usage rates, expiration periods, or eligible Services in accordance with Section 20 (Modifying and Terminating Our Services). Any such changes will apply prospectively and will not retroactively reduce the remaining validity period of Dynarii Credits already purchased, except where required by law or necessary for fraud prevention, security, or legal compliance.
- Effect of Account Termination
Upon suspension or termination of your Account for any reason, including under Section 6 (Prohibited Conduct and Content), any unused Credits remaining in your Account will be forfeited without refund, except where required by applicable law.
- Consumer Rights
Nothing in these Credit Terms limits any non-waivable consumer rights you may have under applicable law. Where required by law, certain restrictions described in this Section may not apply.
